WHAT’S THE WEBINAR ABOUT?

Environmental Justice (EJ) continues to be the focal point of the Biden Administration’s environmental policy, but as we enter 2024, we’re at a bit of a turning point as the administration has faced increased legal challenges from states amidst claims that U.S. EPA has overstepped its authority in enforcing its EJ agenda. Reverses in the court, both related to permits and the agency’s use of Title VI of the Civil Rights Act, threaten to slow progress on EJ at the federal level. Despite these reverses, billions of dollars continue to be made available through various programs and the Inflation Reduction Act (IRA) for community projects and hyper-local and fence line monitoring. Additionally, the 2024 presidential election looms and will likely determine the direction EJ takes at the federal level going forward. Meanwhile, many states continue to push forward with the development of their own EJ policies, rulemaking, and tool development. Many have also begun to build additional EJ requirements into their permitting programs for projects near overburdened communities, either formally or informally, including additional public outreach requirements, impact studies, and potentially air dispersion modeling that otherwise might not be required. This webinar will look at anticipated developments in EJ for 2024 and beyond at both the federal and state level, and the continued increased attention on facilities located near overburdened communities. We’ll also discuss what can be done to stay ahead of the curve in terms of engagement with the public near your facilities and things to consider when designing your project and developing your permit application.

WHY ATTEND?

Challenges to permitting activities on environmental justice grounds, and additional requirements related to EJ at the state level are becoming more and more prevalent and present risk to projects ranging from additional delays and costs to outright denial of operating permits. It is critical to understand your facility’s environmental justice footprint and what new requirements might be required at the state and federal level, as well as steps you can take to be a good neighbor in your community.
